4. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information

  • Deliver required materials on time

  • Maintain compliance with advertising platform policies

  • Ensure that their business complies with applicable laws

Garachana is not responsible for ad account suspensions, rejected ads, or platform policy violations caused by client content or industry restrictions.

5. Intellectual Property

5.1 Website Content

All content on this website (design, text, branding, graphics) is the property of Garachana and may not be copied or used without permission.

5.2 Client Materials

Clients retain ownership of materials they provide.

Clients grant Garachana a non-exclusive license to use such materials solely to perform agreed services.

5.3 Portfolio Rights

Unless otherwise agreed in writing, Garachana may display completed projects in its portfolio and marketing materials.

6. Fees and Payment

  • Fees are agreed in writing before work begins.

  • Payments must be made according to agreed terms.

  • Late payments may result in service suspension.

  • Fees are non-refundable unless otherwise stated in writing.

If online payments are introduced in the future (via Stripe, PayPal, or other providers), additional payment terms will apply.

7. No Guarantee of Results

Marketing outcomes depend on multiple variables including market conditions, competition, budgets, and platform algorithms.

Garachana does not guarantee:

  • Revenue increases

  • Specific lead numbers

  • Conversion rates

  • Ad performance metrics

8. Third-Party Platforms

Our services may involve platforms including:

  • Meta (Facebook / Instagram)

  • Google

  • TikTok

  • Email marketing platforms

  • Hosting platforms such as Squarespace

We are not liable for:

  • Platform outages

  • Algorithm changes

  • Account suspensions

  • Policy updates

9. Limitation of Liability

To the fullest extent permitted under Spanish and EU law:

Garachana shall not be liable for indirect, incidental, or consequential damages including loss of profits, business interruption, or data loss.

Total liability shall not exceed the total amount paid by the Client in the six (6) months prior to the claim.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the business relationship.

11. Termination

Garachana reserves the right to suspend or terminate services:

  • For breach of contract

  • For non-payment

  • For unlawful use of services

Outstanding fees remain payable upon termination.

12. Governing Law

These Terms are governed by Spanish law.

Any disputes shall be subject to the courts of Valencia, Spain, unless otherwise required by applicable consumer protection laws.
